1. General Information
These Terms and Conditions govern the relationship between me (Andrés Martinez-Osorio de la Torre) and clients. By booking our services, you agree to be bound by these terms.
2. Services
We offer mountain guiding, outdoor adventure activities, and other related services in Switzerland and internationally. The services provided will be specified in your booking confirmation.
3. Booking and Payment
Booking: To confirm your booking, a non-refundable deposit of 50% is required. Full payment must be made 15 days before the activity date.
Payment Methods: We accept payment via bank transfer, credit card, or other specified payment methods.
Late Payments: If full payment is not received by the due date, we reserve the right to cancel your booking.
4. Cancellations and Refunds
Cancellation by Client:
More than 15 days before the activity: 80% refund (excluding deposit).
Less than 15 days before: 50% refund.
Less than 7 days before: No refund.
Cancellation by Us: We reserve the right to cancel due to unforeseen circumstances, including but not limited to severe weather, safety concerns, or guide unavailability. In such cases, you will receive a full refund or the option to reschedule.
5. Safety and Risk Acknowledgement
Client Responsibilities: You acknowledge that mountain activities involve inherent risks, including but not limited to falls, rockslides, and severe weather. You must follow the guide's instructions and take appropriate precautions.
Health and Fitness: You confirm that you are physically fit and have disclosed any medical conditions that may affect your ability to participate in the activity.
6. Insurance
You are responsible for obtaining adequate insurance coverage for the activities booked, including accident, travel, and rescue insurance. We highly recommend insurance that covers mountain rescue and evacuation.
7. Equipment
Client's Responsibility: You are responsible for bringing suitable equipment and clothing. We can provide a list of recommended gear upon request.
Rental Equipment: If rental equipment is required, it must be reserved in advance, and rental fees will apply.
8. Liability
We are not liable for any injury, loss, or damage incurred during the activities, except where it results from gross negligence or intentional misconduct by us.
9. Privacy and Data Protection
We respect your privacy and will handle your personal information in accordance with our Privacy policy.
10. Dispute Resolution
Any disputes arising from these Terms and Conditions will be resolved in accordance with Swiss law. The exclusive place of jurisdiction is the Cantonof Bern.
11. Amendments
We reserve the right to amend these Terms and Conditions at any time. Changes will be posted on our website, and your continued use of our services constitutes acceptance of the revised terms.
